Australian Online Dating Code of Practice — Compliant

1. Use of the Service

The Mingle Movement is a live video dating service for adults aged 18 and over. By registering and using the service, you agree to these Terms & Conditions in full. You must provide accurate information, treat all other members with respect, and comply with all applicable Australian laws.

2. Eligibility

  • You must be 18 years of age or older to use The Mingle Movement.
  • You must be a natural person — corporate or automated registrations are not permitted.
  • You must complete our identity and liveness verification process (AI facial scan) before accessing the service.
  • You must not be subject to a current ban or account termination from The Mingle Movement or any related service.

3. Prohibited Content and Conduct

The following are strictly prohibited. Violations may result in immediate suspension or permanent termination, referral to law enforcement, and civil or criminal liability under Australian law.

3.1 Sexual Misconduct

  • Sexual harassment of any kind, unsolicited sexual comments, requests for sexual acts, or persistent unwanted contact of a sexual nature.
  • Abusive, threatening, or coercive language of a sexual nature, including threats to share intimate images.
  • Online stalking — monitoring, tracking, or repeatedly contacting a user without consent.
  • Sexual assault or coercion — pressuring, deceiving, or threatening another person into any sexual act.
  • Reproductive or sexual health abuse, including reproductive coercion or deliberate deception about sexual health status.
  • Image-based abuse — non-consensual sharing, threatened sharing, or capturing of intimate images. This is a criminal offence under Australian law and will be reported.
  • Grooming — any attempt to build trust with a user for the purpose of gaining access to children for exploitation or abuse.

3.2 Non-Consensual Intimate Images

Uploading, sharing, distributing, or threatening to distribute intimate images of any person without their explicit consent is absolutely prohibited. This includes deepfakes and digitally altered images. Non-consensual sharing is a criminal offence under the Online Safety Act 2021 (Cth) and applicable state laws.

3.3 Child Safety

The Mingle Movement is strictly an 18+ service. Any attempt to access, contact, or connect with persons under 18; uploading CSAM; or providing false age information will result in immediate termination and mandatory referral to the Australian Federal Police.

3.4 Illegal Content

Content that is illegal under Australian law, constitutes hate speech, infringes IP rights, or facilitates fraud or romance scams is prohibited.

3.5 Platform Misuse

Circumventing verification or bans, using bots, harvesting user data, or commercial solicitation without authorisation is prohibited.

4. Safety and Permissions

  • Video calls require camera and microphone permission. You can revoke these at any time, but calls will not function without them.
  • Call media is handled in real time and is not recorded by the app.
  • Your contact details are only shared after you explicitly choose to share them during the video call. Once sent, the other user may save or use them outside the app.

5. Account Actions and Enforcement

We may take graduated action proportionate to the violation: content removal, feature restriction, temporary suspension, or permanent termination. Serious violations (sexual misconduct, image-based abuse, child safety, identity fraud, repeated lesser violations) may result in immediate termination without prior warning. We take reasonable technical steps to prevent banned users from re-registering.

Data retention: deletion requests honoured within 90 days; data may be retained longer for serious violations, law enforcement requests, or legal holds.

6. Complaints and Reporting

You can report another user's conduct (sexual misconduct, harassment, abuse, threats, stalking, image-based abuse, grooming, scams, suspected underage users) or our handling of a previous report.

  • In-call: use the block & report button visible during any video call.

  • Urgent: if you or someone else is in immediate danger, call 000.

We will not act on frivolous or vexatious reports. Records are retained for at least 12 months. We will not disclose your identity to the person reported without your consent, except where required by law.

8. Limitation of Liability

To the maximum extent permitted by Australian law, The Mingle Movement is not liable for any harm arising from the conduct of other users. Nothing limits rights you have under the Australian Consumer Law or other non-excludable statutory protections.

9. Changes to These Terms

We will notify registered users of material changes via email or in-app notification before changes take effect. Continued use after notice constitutes acceptance.
